If the childs or childrens father is in errors on his child support then you can take him back to court for contempt and once that is done the state can take away his drivers licence,he can spend some jail time, his checks can be garnished and you can get his incom tax refund if he files and has any tax refund due him the state will take it and send it to you. So i would take him back to court so that this can be done.

If he recieves a refund and is not married you are entitled to the full amount he owes you plus or minus any overages....If he is remarried and his spouse works you may only get his portion of the refund because she can file what is called an injured spouse form. She will keep her refund and only what he paid will be available. I dont know about your state but in the state of Missouri it takes approximately 40 days to process this from the date he recieves his refund. The state may get it before then but they hold it for atleast 40 days before you will recieve a dime. His state taxes will be held as well and it takes about 21 days to get that money. Hope this helps.
