Why do i have to pay alot of my check to child support?

All I get is $400.00 a month and they take $350. I get that for per-capita payments. but thats the only check that I get. Why do they take so much?

You need to go and see about having your payment reduced. It is possible that when your payments were set up that you were making more money than you are now. You can have them review your payments and payment history to show that you are no longer making what you were then.

My understanding is that child support payments are based on the amount of money you make, the amount of money the other parent makes, the needs of the child(ren), and whether or not custody is shared. You should definitely support your children as best as you can but I can see how very difficult it must be for you to live on the small amount that is left after the payment is made. Perhaps you should talk to your lawyer about getting the payments adjusted. I believe that can be done. Blessings to you and your family.

It depends on the state you live in but generally, there is a percentage limit to how much can be taken from each paycheck. Either check with an attorney or your state child support agency to verify the maximum amount (or percentage) that can be taken. If you are behind in your payments, they may be able to take more from your check but you need to find out for sure.

That is really a lot of money. Maybe you do not make noise, that is why they keep on deducting such a large sum of money.

If this is a tribal payment, you'll have to check with your council to see if there are any limits in place on how much of your per capita payment can be garnished. If you didn't object when notified, they'll simply pay it as ordered.

If you've never worked, the court has obviously given you an implied income and your being voluntarily unemployed has left them garnishing your only other income source to collect from.

It seems to be a lot of money that is taken for child support in relation to what you are earning. I would check it out quickly and see about getting it reduced as $50 a month to live on seems very unreasonable. Get some advice quickly before the next payment is due to go out. It may be that they are not fully aware of your circumstances, so ensure they are informed fully of your financial situation.

You may be paying so much for a couple of reasons the first is that you could have been making more when the amount of child support was determined. The second reason is that the court could look at how much you are earning and realize that you are not earning as much as you could. If all you bring home is $400 per month then you are not even working full time. You have a responsibility to your child and should be making every effort to increase your earnings. The courts will look at how much you are capable of earning. If you earn minimum wage which is $7.25 per hour x 40 hours = $290 then allowing 28% for taxes leaves $208.80 per week or $835.20 per month. This is quite a bit more than you are currently earning which tells me you are not working full time and since you are choosing not to work full time the courts are taking the majority of your money for your child. While taking $350 of $835 is still quite a bit it would leave you more money to live on. You should consider looking for ways to increase your income and perhaps work a second job for the things you want. Your child deserves to be supported and I really don't think you will have much luck going to court to ask for a reduction. I know far too many fathers who were downsized at work or took a lower position and do not make the money they once did. The courts did not lower their child support because they felt that you made a choice to earn less and since you were capable of earning more you should find a way to earn that again. I am not saying that it is fair in any way but I do see both sides on this. The court at the end of the day has the obligation of looking out for the interest of the child not the parents.
