Where does child support payments go if child lives with grandparents and is now 18?

My step-daughter just turned 18 and will graduate high school in 4 months. She has lived with her grandparents for about 5 months. My husband continued to send the child support payments to the mother per suggestion of our attorney. The mother agreed to send the payments on to the grandparents, but has only sent 3 weeks of checks there. The grandparents and the 18 year old has just asked my husband to forward the checks to their house to be put into a savings account for college since the mother has not done what she said she would do. The mother gave permission back in August for us to send the checks there, but is now threatening court. She is also severely mentally ill. Where do the payments go?

Until you get the order changed, continue to send them where ordered.

I ran into a similar situation with my daughter, the cost of the change in lawyer/court costs/bad will would have been more than the few remaining months left. Some things simply aren't worth fighting over, particularly if you are dealing with an unerasonable person.

The father has to continue to follow the stipulation order of the court and pay his child support to the mother, the lawyer should not of sujesed to the father to send any payments to the grandparents. The mother should be giving the money she recieves to the grandparents, but legally she does not have to . What should of happened when the child lived with the grandmother the father should of file a petition asking for custody. The promblem here now is the child is 18 the legal age of emancipation, the father still is legally responable to pay child support for the four months until she graduates. It is not worth the time and money that it will cost he father to prusue this now. The daughter and or grandparents need to talk to the mother and see if they can convince her to give the support to them. The father is as wrong here as the mother she is taking the child support, but he never tried to change custody and since he never filed a petition then theres not much he can do after the fact. If the child is mentally ill then the father could be ordered to pay child support for several more years, if she is getting SSI or SSD benefits the the mother needs to be reported to social security, so the grandparents can try to becme the guardian and become the payee of the childs benefits. If this is the case then her is the SSD number 1-800-772-1213 also the report of change of address can be reported by going online to www.socialsecurity.gov if you do this then the father will need or the grandparent will need name of person receiving the SSD or SSI benefits, the date the change happened (5months ago) the signature and address and phone number of whoever makes the report.

The father has to follow the court order. But if the grandparents are raising that child, the order should have been changed so the grandparent get the sapport. If the mother is not paying the grandparent they need to take her to court to have her pay that money that is owed to them. Once the child turns 18, And not in school the child sapport should stop. But if the child is 18 and still in school the money goes where it was ordered. My suggestion is to talk to the mother if she doesn't agree to pay them the money, Then tell her your going to court and she will be made to pay it. your trying to make it easy on her. But if you have to you will tke action. And mean it. Take action. That money is not for the mother, It is for the child. And thats where it should go. Good luck I hope all works out well.
