Where can i find step parent adoption forms for illinois, My husband wants to adopt my 4 year old son his bio dad hasnt seen him or paid child support in two years how can my husband adopt my son |

Inorder for your husband to adopt the child you will need the consent of the father. The way to get around this is to file against the father for abandonment if you do this then his rights could be terminated at which time you can then allow your husband to adopt the child. If the father and you were never married and he did not sign the childs birth certificate then he has no legal rights until he files a petition though the court asking for joint custody and or for visitations. If there is a current joint custody or visitation order now in effect you will need to have the father's consent. You need to contact a lawyer for additional information on your state laws.
