When does Child support payments stop?

If your child turns 18 and is in independent high school as a senior does the parent still have to pay support?

You are required to pay child support until the child reaches 25 or is dont school completely, if he graduates high school and then two years later decides to go to college you are required to pay, until they are done school....BUT only if they are living at the other parents house...if they move out at any such time and become a legal "adult" then you are scott free and dont owe a thing, so if you kid goes to college encourage then to get their own place lol

First of all child support is never until the age of 15 in any state. In most states the age of child support ends at the ag of 18 or when the child gradurates hign school. In some states the age is 19,and there are a few states that the age of child support ends at age 21 if the child is a full time student in college. There is only one state that allows child support to be paid until the age of 23 if the child is enrolled in accredited higher education and that state is Hawaii. States that order child support UNTIL THE AGE OF 21 IS MISSISSIPI,INDIANA, NEW YORK, STATES THAT ORDER A PARENT TO PAY CHILD SUPPORT UNTIL THE AGE OF 21 IF A FULL TIME COLLEGE STUDENT ARE, MASSACHUSETTIS,OREGON, STATES THAT ALLOW FOR EMANCIPATION OF A MINOE ARE GEORGIA,ALABAMA,COLORADO,MONTANA,NEBRASKA,RHODE ISLAND,KANSAS,SOUTH CAROLINA,TEXAS AD UTAH,IF THE CHILD JOINS THE MILATARY,OR GETS MARRIED OR LIVES ON THEIR OWN HOLDING A FULL TIME JOB AND SUPPORTING THEIR SELVES. bUT JUST KNOW UNLESS THE CHILD IS EMANCIPATED YOU ARE RESPONIABLE TO CONTINUE TO PAY YOUR CHILD SUPPORT UNTIL THE AGE OF 18 OR THE CHILD GRADURATES HIGN SCHOOL,UNLESS YOU LIVE IN ONE OF THE STATES THAT I NAMED THAT REQUIRES YOU TO PAY UNTIL THE AGE OF 21,23 IN HAWAII

What state are you in? some state it is 21 , ome state have a statutory recognition of a parents responsibility for college other do not, in all cases your decree would control unless it is amende, or state law was changed since your decree, and then the parent OR child can seek collge support.

I had to pay child support until the last of 2 had turned 18 and graduated from High School. Support can go on under certain circumstances and depending on the laws of the state you are in or the state that ordered the payments. You can also go on the internet and do a search using states name child support laws (i.e. North Dakota Child Support Laws)

I guess according to state laws.......a child no longer needs financial support when they graduate high school. I find it amazing that they are supposed to magically become financially independent at this milestone in life.
Based on my experience when they finish high school and begin college.......they require even more financial support. Go figure...

I pay childsupport for 3 kids in texas and have a child at home who is a toddler. i live in sc and my oldest child who is 16 ran away from texas and now in sc with my sis. She drop out of school so would i still have to pay for her since they have lied to to the courts that they are raising the kids right.

As previously stated, child support ends when a child turns 18, or graduates high school - whichever happens LAST. In addition, I find it unnerving that the following was mentioned above, "I find it amazing that they are supposed to magically become financially independent at this milestone in life." Unfortnately this individual has obviously never been on the paying end of child support and watched their money being squandered away, while the child it was meant for had little to no contact and received little to no money. Also, by the time a child graduates high school, they know college is coming, they know they should be responsible and have a job already, or lined up. When are we finally going to place responsibility where it belongs and teach our children to WORK for what they want - not everything in life will be handed to them!

I agree with SRDEsq if you were to post your state we could give you the acurate information on the laws in your state for the age that child support ends as well as if you have to notifly the court to have the child support stopped when the child turns of age. Hopefully you will list your state if you ahve any additional questions on your state laws. Thank you for choosing the webanswers for legal advice.

Child support normally follows until the child turns 18, or at least that holds true where I live (California). The state you are living in is going to determine what age you are required to pay child support until. Some states also may require that you support the child until school is completed, or can even include putting the kid through college.

The best decision you could make would be to talk to a qualified lawyer, and voice your concerns to them. A lawyer is going to be able to tell you just what is expected of you in your state, and under your specific circumstances.

In responds to Norrin: the laws in california for child support is that child support ends when the child reaches the age of 19 or until the child graduates, b ut not past the age of 19 and inorder for the child support to continue past the age of 18 in california the custodial parent has to notifly the child support agency and report that the child is still in school, when this is done the child support services then sends a letter to the childs school for the school to fill out and send back on this form the school has to have their letter head the name of the child and if the child is a full time student and if so when the date of graduation is to be. This has to be done inorder for the custodial parent to continue to recieve child support, for any questions regarding this law you can contact the child support serv and although I am aware this is just an example of their state law here but just want you to no that the information was not acurate for california.

My daughter lives in Indiana, of course one of the 3 states where support goes till the age of 21...if she moves out and goes to school wherever (her address is no longer at home with her mom) do I still have to pay child support? I would surely hope not!

Child support is to be paid until the age of 21 as you no. Chid support still has to be paid even when the child moves out, unless there is a stipulation in the current order that states when the child moves out of the home that the support then goes to the child, you need to check what the ordeer states, the non-custodial parent can also file a petition to modifly the orignal order and ask the court to change the child support to be paid to the child. This is usally what happens and is usally stipulated in the order, if it was not in yours then file a motion to modifly the orignal order.

PayingDAD,

Being away at school is considered a temporary absence from home, it's not an act of emancipation. Your support as ordered under Indiana laws will continue even if she attends college out of state.

You should be proud that she wants to continue her education. You'd be paying if she was working a crappy part time job after high school and living with her mother, so why complain about paying as she continues her studies?

What if my daughter decides to come and live with me? That does not seem fair at all that I would still have to pay the mom when the child is now living with me.

If your child comes to live with you then file a petition though the court to stop the current child support. The court cannot stop it if you do not report your child is residing with you. The child is 18 so she can decide if she wants to live with you, the court is the only one that can stop the current child support.

IMHO,

I am not at all against paying support for my daughter or her continuing education...what i am against is paying her unworthy mother all of this money and not seeing it go toward my daughter. If I can file a petition at that point to make sure it goes to her then I am completely fine with that.

Here is the next money question as I Have seen so many times...at what age can she decide to come live with me? I have seen many different responses to that and that it is primarily up to the judge and the maturity level of the child IF they even allow it before they turn 18. But I have heard they can decide at 14...I have years to go, but my daughter would move with me in a heart beat right now, so I was just curious as to how early that could happen.
