The cut off age for child support in NY is 21 years old. Most Judges only allow children to become emancipated in extreme cases such as the parents tell the child they hate them over and over again. The parents abuse the child emotionally or physically. And the child must prove that they can financially support themselves without help from friends, family, or the welfare system. It is very hard for children to do this and Judges don't grant this very often.

In essence,prior to the age of majodity,marriage,or entry into military services, so long as a child is still in need of the care and custody and control of his/her parents,the child is not emancipated. " Emancipation- before the age of majority is never presumed,but must be proved by the party seeking to terminate support.
