What do i do if my ex-mother-in-law claimed my son on her taxes?

I have sole custody but my divorce states that my ex-husband is supposed to claim my middle child but he hasn't paid child support in a year because he quit working so he had his mother claim our son is that legal and what should i do about it?

Yes, it's illegal. The mother-in-law provided no support to your child. You can amend your taxes to claim the child and the IRS will ask both parties to prove their right to claim. Your ex mother-in-law has none. You will win by default.

It is called fraud. You should get the support you are supposed to get so that you ex-husband can clain the children as his dependents. If you think that will not happen you can go to court to get the settlement changed to reflect the facts, but I would stick it to the ex with the support court giving him a big hurt.
