What are the laws on back child support? My ex says that he does not have to pay back child support, because a new law has been passed stating that they no longer have to pay for arrears. I have not been able to find any information regarding child support laws in regards to arrears, I am not sure what is accurate and what is not. |

There is a knew law that passed that if you did not file for child support prior to the knew law that you could not file for any child support errors. Because you did not have a court orderd child support. however if you already had a court orderd child support enforce prior to this knew law then yes you can still collect all back child support in the rears. Sinse this law has passed you can only collect from the time that the court orders the child support.

When it comes to child support laws they are nothing but corrupt.
The ones that are making money are the lawyers, the judges and the states and of course the custodial parents.
They could care less for what kind of hurt or burden they put upon you.
The custodial parent probably has been hurt through the court proceedings and all they want is revenge
so they take there lawyer buddies and judges and stick it to you. They don't care what kind of life you have to live
or that you cannot live because of there burden. Even when you try to pay usually something always happens and
you fall behind and then guess what, you wind up in jail and they think that helps.
Stupid people just don't now how to think common sense. They aught to know that if you are in jail then you surely can't pay.
They will take your license and anything else they can take. They make it to where you can't pay and then THEY PUT YOU IN JAIL.
I think it is a dirty rotten shame that people treat people like that especially our own corrupt ass government.
I just look for the day that our lord comes back and then we will ALL pay for what we have done.
Especially the greedy ones like the judges,lawyers and custodial parents. GOD HATES GREED

There is a difference between the law that passed in most states where the custodial parent cannot file for child support and go back earlier than the month he/she filed. Back child support erarages cannot be dismissed unless the custodial contacts the child support services to wavier those erarages.

If arrears are already court ordered as owed to you, the only ways he can get out of paying them is if he can prove they were never owed, he can prove he already paid them, or you choose to forgive those arrears.
When an order is being established, arrears are set for previous unpaid support according to the laws of the state you are in. In most cases, in order to establish any retroactive arrears the custodial parent has to provide receipts showing they paid the expenses for the child and the non-custodial parent must be unable to prove that they paid support.
