Vawa A few years ago I read Federal Statues and/or laws pertaining to retroactive child support when the mother had to flee to protect/keep her and her child safe from Domestic Violence. Now I cannot find these, do not know where to look. It's possible that they were in the Violence Against Woman Act, or in Federal Family/Domestic Law...in any case I would like to find these and I am having trouble on my own. Can anyone help me locate the Statues and the number/place to find these laws? I distinctly remember that they were FEDERAL and not state. |

The Violence Against Women Act of 1994 (VAWA) can be found here:
http://frwebgate.access.gpo.gov/cgi-bin/getdoc.cgi ?dbname=109_cong_bills&docid=f:h3402enr.txt.pdf
I am not sure how availing this is, and the Department of Justice's Office of Violence is equally "fluffy", although there might be resources that might be helpful.
Which brings me to my question: What exactly are you seeking? If you are inquiring about past due child support, the Uniform Child Custody Jurisdiction And Enforcement Act (UCCJEA) is a uniform code that ties most of the states together in the enforcement of custody and child support.
While UCCJEA looks like a federal law is is not.
Let me know some specifics, and I will be happy to provide you the right information.
Thank you for your question, USladidi62.

VAWA didn't help me at all, it seemed to focus on grants and education matters. what I am looking for is a circumstance where a parent was relocated to another state by victims services (DV) for crimes against the child..( did 2 yrs for felony child abuse). does this child have any rights to child support from her abuser? mother had good cause to not persue CS at that time for fear of violent retribution. Now that they feel safe to file, what are the childs rights to any retroactive support? Does fear of violence excuse him from paying any support? or any support during the time parent was in fear of filing?
