The spousal support is a maybe at best. She may get it, but if you canprive she has an income of her own, it's not likely.

The child support, on the other hand, is not dependent upon her income. It is dependent only on your income and the fact that there is a child between you.

It’s amazing to hear what people will do get out of paying support and what they will do to screw another party to get the most money possible. It sounds like you are dealing with the second scenario.

Will she be awarded support that’s a heavy question without knowing lots of information. If she was a stay at home mom with no income of her own she may be awarded support for a time. No matter if she has a job now or not. However if she did have a job during the marriage and it was comparable to what you made she may not qualify for spousal support.

What you can do to help prove she has income is see if you can find info on her business. Meaning business cards websites ect. IF you can find any receipts or company info that you can take to the court.

The best thing you can do for yourself is document everything. As much as we love to say we remember everything we will not that’s why its best to have it all written down for future use.

The matter of child support will also depend on incomes but not inclusively. Its going to depend on who gets custody or how custody is split. If you have 50/50 custody child support may be minimal or not awarded it all depends on your states formula. The family court as a whole is moving to a joint/joint custody arraignments because the children deserve two responsible parents.
