Ohio child support issues

I am a stay at home mom. My 16 year old decided to move in with her dad. (I just moved to Florida he lives in ohio) I have 3 other children living with me. When she moved he told me he would not go after child support and now he is. If I have to go to work to pay for child support I have to put the 2 smallest children in daycare, which we cannot afford (thats why I stay home). To do this I would have to go on welfare. Is this taken into consideration with the judge? Also the father owns his own company and only claims making 64k a year to my nothing. I never in the 14 years of him paying took him back for more money. He was only paying 276 a month.

In my new case it states that defendant requests the neither party pay child support to the other as any deviation of the child support guidelines is fair and just and is in the best interest for the children. dose this mean we can not ever get childsupport we are the defendants?

Who was your attorney? A man making $64,000 a year with 3 kids would have to pay more than $276.00. In Ohio, child support is based on your bills and what the father makes. The state of Ohio has a formula that they go by. My son had two kids and didn't make $50,000 and he was paying over $800.00 a month. I think you need to contact family services and find out why you were only getting $276.00. You can tke him back to court and have your pay adjusted.

If you did not file a motion giving the father custody then until you do or he files a motion for custody then he cannot have his child suppport payments stopped, nor file for child support aainst you, you may want to consider having your daughter move back home. if you ended up having to apply for state benifits then you would have to give the state consent to go after the non-custodial parent for child support. If the father owes you any back child support you need to have those payments enforced by contacting the child support services, he is not to smart if he owes you child support and exspects the courts to make ou pay him support. Also if you have proof of what he does make then you can report that to the child support services and or to the court.

You have alot of issues going on here you have children with behavior promblems and so you stopped going to your classes for massage thrapy, and you are depressed. It sounds like you are over whelmed with so much going on in your life, you mightr want to get some counciling for you and the children. If you and your husband are considering splitting up and agreeing to joint 50/50 shared custody he may still be required to pay child support, if your not working and have been a stay at home mom and if you were able to work if you could not ake the same a mount of money as your husband thne yes he will have to pay child support. Even with joint custody if one parent earns more income than the other the parent earning the larger income would pay child support. You can call a lawyer that offers free consutation for the free legal advice. You do not have to hire the lawyer for repersentation. If you do want a lawyer you can request that your husband pay the lawyer fee.
