My exhusbands girlfriend filed for child support for thier child, 30 days before they were to get married. Lowing my support order payments. I live in the State of Missouri. We were divorced 2 yrs ago & a Support Order was enforced. He had a girlfriend who was expecting (I had no idea) at that time. I started getting lower payments 4 months ago. I called Child Support Enforcement, seems he now has another support-order for thier child now & this affects my order. The tricky part, his girlfriend filed for child support 1 month before they got married. Married couples do not pay child support for thier children, right? Seems someone knew the system and are regaining some income by deducting from my support order. Is this legal? |

Well looks like someone is pulling a qick one on you. They knew what they were doing when they did it. What you need to do if file a motion to modifly the orignal child support order back to what he had been paying for child support. You need to tell the court he is now married and is not paying child support to another child. If it were me I would ask to have the child support raised. That would serve them both right. The court will not keep the child support lowered now that he is married because the court looks at both of the parents as being able to work so his knew wife can get a job. I hope that you don't prolong this do it asap.

A quick one for sure. But this has alot more to do with just myself. To me this is why our country is in the the situation we are in. They are bringing in income that is not being taxed. He makes very good money, tax on an extra $800.00 a month. is tax evastion.Not right we all have a duty to do things right.

Married couples do not pay child support. Assuming the child lives with them, they are providing the necessary support; it would not make sense to pay child support to themselves.
You can always file for reinstatement of the original support amount because of a change in circumstances (i.e., they are married now and living together, making child support unnecessary).
