My Ex- Husband who owes more than $80,000 back child support, filed his taxes jointly with his new wife. He recieved a letter stating the IRS took it.

Bottom line, I know they kept his return due to back child support. I have tried to get it the last 4 years and have never seen a dime. This year the IRS actually took it. I know they are smart enought to file the 8379 and in turn the IRS will take back her portion. Does he have a portion? With only collecting SS disability and VA disability, he technically owes no taxes and would not have a refund. How can I get any back child support? Child support enforcement is a JOKE. I live in AZ if it makes any difference? Thanks for any HELP!

Sounds like you already know the answer -- if he had no taxable income, the refund belongs entirely to the new wife, and she'll get it back by filing an 8379.

Some guys have figured out how to game the child support system.

I can offer only sympathy.

I can't offer much more than Reader did.

I don't like the idea of re-instituting debtor's prison, yet men like this, should face it when they have the means to pay at least something and simply choose not to for so long that they accrue and arrears as high as that.
