Is there a form that I can fill out that says I will not file an injured spouse form so that our taxes they took can be put on his owed child support My husband owes child support and I filed taxes with him so that our taxes would pay off most of what he owed. I was told that the taxes are held for 6 months before they are sent to child support so that the wife (me) can file an injured spouse form if wanted to. I do not want any of my taxes so that we can get his child support up to date. I would like to know if there is a form stating that and how do I get it. |

File form 8379 or call the IRS at 800-829-1040, which during this time of year will be answered sometime in July but the best bet is to go to the local IRS office and see if they can speed things up. Go www.irs.gov and click on the Contact IRS button in the upper right hand corner. If you do go, bring a snack, it's that time of year

There are no forms to be filled out in order to speed up the process of the moneys being released. What the injured spouse form does is slow the process down quite a bit. From my understanding its not the IRS that holds it for six months, it's the child support agency that holds it, There is nothing they can do and nothing you sign can release that money. I went through this process thinking that the injured spouse form will speed the moneys being released which is just the opposite. All it does is give the current spouse an oppurtunity to try to get thier portion of the money which isn't for sure either that they would get any of thier portion. So try to stay patient and let go and let God handle everything, otherwise the one thing you could do is slow the process down which is what you are trying to avoid in the first place. May your money being released to you in a timely matter and it is true that good things come to those who wait. Sometimes the best thing to do is the hardest but most rewarding.

I was going to file as married and filing joint, but i think they will take all of my husbands refund and put it towards his child support. i know i can fill out the injured spouse form (8379) to be able to still receive my returns, but i do i need to mail that form to the irs before i file my taxes?...
