Injured spouse form

I was going to file as married and filing joint, but I think they will take all of my husbands refund and put it towards his child support. I know I can fill out the injured spouse form (8379) to be able to still receive my returns, but I do I need to mail that form to the IRS before I file my taxes? I am doing my taxes on Turbo tax. Or can I just e-file them, and then mail them the form. Do i even mail the form, or does it go to them since I am doing it through turbo tax? sorry so many questions, we just got married last year, so I never had to fill out that form before

If you are filing your Injured Spouse (form 8379) at the same time that you file your taxes:

*No*, you do not need to print and mail the form. Turbo Tax will take care of this for you. They have the Injured Spouse form 8379 available online, so you won't have to print it out and send it. Just make sure to go to the "Other Tax Forms" or "Miscellaneous Tax Forms" section of the Turbo Tax menu and fill out the information on Innocent/Injured Spouse. It will ask you a few questions, checking to see if you qualify for *innocent* spouse first. Then it will ask you a few more questions to see if you qualify as an *injured* spouse.

I used Turbo Tax last week. My husband and I e-filed as married-filing-joint, and I am the injured spouse. Turbo Tax followed all the directions and filled out all the forms necessary. The IRS accepted our return with no problems.
