Inheritance:Does child support arrears get paid first over back taxes? My ex is coming into a large inheritance. He owes 12000 in child support arrears and back taxes for 2 years. He is claiming that back taxes are taking the majority of the inheritance. Isn't child support arrears before back taxes? Please let me know asap as we are in a modification dillema where I am getting 50 cut in cs and alimony, but I have not signed the modification because of finding out about the inheritance recently.

You need to report the inheritance to the court. Not only will they be able to attach the inheritance for child support arrears but you may get an increase in child support because inheritances are considered income when figuring his share of child support. So do not sign the modification! As far as the IRS goes, if they find out about the inheritance, and they will, that is when they will attach the inheritance by placing a lien on it. I don't think your ex would voluntarily notify them of the inheritance, so in this case I believe because of the order of discovery, child support will get paid first.
