If married to a us citizen and also have children that are us citizins can mexican immigrant be deported? Mexican illegal immigrant is in jail for DUI and then will be in for Child Support. He is divorced from the mother of the children who are us citizens and he is remarried to a us citizen can he be deported? |

That will be up to the judge to determine. His being married to a citizen could make a difference,but don't count on it. Does he have a green card.that makes a difference. You can consult with an attorney,they offer free constation at least most do,find one and call and ask for legal advice. A DWI is a serious offence in itself so the court may think that ie it is less costly to deport him then to charge him. Again it is up to the court. Either way it goes he will not just get off.

Just because he was married to a us citizen doesn't mean he got his papers. If he does have papers a judge can still take them away. Papers just say he is allowed to be here they don't say he is a us citizen. So yes there is a chance he could get deported depending on the judge. He defintly needs a lawyer.
