If a child support payee gets a second job, do child support payments increase? If a person who is paying child support gets a second job, do child support payments increase? |

Hi.
I feel your pain, smiles. The answer is 2 part. 1st, your income is increased so you now have the ability to pay more. Your child support equation is based on both parents annual income and divided between the two based on percentages of income and liabilities. 2nd: Just because you have the ability to pay more, based on an increase of wages, does not mean the other parent will request that you pay more, just because your financial status has increased, you feel me? So, my advise to you, as a adolecent phsychology major, single mother who pays and recieves child support.....keep your 2nd job to yourself, really there is not reason to have "bragging rights" about this respectable persuit equally if you think your child is suffering financailly because he/she does not have enough contributed financially from you, you then have to make a moral decision and then a legal decision. This is the same question that I had. I realized that my ex husband re enlisted in the Military in 2008 3 months after our divorce in 2007. I am just found out after seeing him in uniform at a work site. He has been giving very little child support monthly which never comes in on time and I always was fine with him doing little because I thought that was all he could afford. I am suspecting that he has been receiving additional benefits by claiming our kids as dependents saying they are living with him but in reality he only has them 6 days out of a month, when he makes it to pick them up. We have a court date soon to resolve this matter. I don't want to come off upset but I am. As a single mother I could have been easier providing for our children with his extra support. When I get extra on my paycheck I have to pitch in so should he.

Child support payments will not automatically increase when the person paying child support has a change in income level. When it shifts up it falls to the person paying child support to file to have it decreased to match his new lower income and when it increases it's going to fall to the parent receiving child support to file and ask a judge to review the new income coming in in order to set a new child support payment (I say it will fall to the parent receiving child support because most parents paying child support will not voluntarily go to court to tell they have a second job and want to pay more; some may though).
So get a court date for modification of child support set and a judge will handle it from there. Most likely with a second job child support payments will increase some.
