I understand that there is a maximum percentage that the state of florida can take out of a single paycheck. Does that same percent maximum fall on what my EMPLOYER is allowed to take?

I believe that the maximum percent for the state to take is 65%. However; my employer has taken out way over that because either she or the payroll company has taken out 5 pay periods (two weeks) of child support payments, which is about 110 every two weeks, out of a single check. Can you clarify a bit for me? You're saying they took ten weeks worth (five pay periods that are two weeks long) out of one single two week period paycheck?

Had they neglected to take it out for the previous four pay periods and were simply making a correction?

Hello. i cannot help with Florida Law, but Child Support is a Federal program, even if each state can make small changes. In California employers cannot take more than 50% of your weekly. biweekly or monthly wages/salary or any earn income. And only 25% of unearned income like unemployment or disability, social security income etc. Here the employers get a very detailed legal document with instructions on how to collect the support amount. Regardless if they made a mistake or forgot to start the collection on time, they cannot fix their problems by leaving you completely broke. I suggest that you go to your local child support agency asap.
