I understand that there is a maximum percentage that the state of florida can take out of a single paycheck. Does that same percent maximum fall on what my EMPLOYER is allowed to take? I believe that the maximum percent for the state to take is 65%. However; my employer has taken out way over that because either she or the payroll company has taken out 5 pay periods (two weeks) of child support payments, which is about 110 every two weeks, out of a single check. Is she allowed to do that? |

Hello. i cannot help with Florida Law, but Child Support is a Federal program, even if each state can make small changes. In California employers cannot take more than 50% of your weekly. biweekly or monthly wages/salary or any earn income. And only 25% of unearned income like unemployment or disability, social security income etc. Here the employers get a very detailed legal document with instructions on how to collect the support amount. Regardless if they made a mistake or forgot to start the collection on time, they cannot fix their problems by leaving you completely broke. I suggest that you go to your local child support agency asap.
