I live in NY and have an open child support case. Now my ex and kids moved to a different county in the last year but she is taking me to court in the old county. Can she do this? My case is thru one county (Chenango) for child support. has been for a few years. Now the ex and my kids moved to another county last year. they haven't resided in Chenango for over a year but yet just recently she has taken me to court for owed child support. reason is because she has gotten assistance thru Department of Social Services. So they are taking me to court. But it is Chenango county court. And she lives in Broome county. Has for a year. My question is how can they keep it in Chenango county court when she doesn't even live there. Is this possible and should I see if this is not legal? As far as I knew you had to take it to court in the county you reside in. Am I wrong? |

If she's been living in a county for more than 6 months, then that's her residence and the county in which she should file her case. She started it in one county, but should have transferred it to Broome County. They should have done a Motion to Transfer Venue. Get an attorney to help you out.
