How do i file a motion to stop cild support ? I need to know how to file a motion to stop child support ? i hired a lawyer in april but the first hearig was just last week and the next hearing is not till the middle of august , i've had my kids since march and i'm sick of paying child support |

Since you have already had a hearing, then I assume the lawyer already filed the motion. Then the other parent is served and given a certain amount of time to file an answer to the motion. Even if they don't file an answer there is a certain amount of time allowed. So that is why you have to wait. The next hearing should get you a judgement to stop the support. You probably already have been advised that you need to continue paying until you get the stop order. It may seem unfair, but while your court case is going on, the child support is supposed to be held in a neutral account. You will get an effective date for your stop order which should go back to the date your lawyer filed the motion (even if you had physical custody of the children before then) and you should get a refund of support paid from that date to the current date that the funds are released.
