There is no way that you can get child support while the father is in prison. However you can apply for state assistance for medical benifits and food stamps. Cash benifits will depend on your curcumstatnces. When the father gets out then you can pursue child support against the father. You can go online to statebenifitsinallstates.com and get an address and phone number of the nearest office to you.

You cant get any support while he is in prison. My sons father has been in jail for 7 years. I was able to get the welfare type healthcare for me and my son and food stamps for a little while, but then I started making five dollars over the limit to keep these benefits so they dropped me. I had to strip to pay the bills, how lovely that all my dreams and goals in life can be so affected by this "man" and I was reduced to self degradation by his choices. Scumbag fathers sit in prison with their free healthcare and play basketball all day while we single mothers are paying the price for their crimes. And it sickens me that so many people sit on their asses with their hands out while hard working citizens like myself get dropped. Its a pity. Good luck to you. Maybe you have family that can help you out in the meantime?

I am in the same situation, my kids father was in jail for three years, and was out of jail for about three monthes, and now is about to go back for four years, I heard if they are in there for five years the state will pay you child support, my friend got $200.00 a month for hers

You should contact your local Child Support Services office. I am in a similar situation, my ex husband is about to go to jail and one of my good friends is a cop and I had asked him before about this situation and he said that in the event that my son's father goes to prison, I will then start receiving payments from the state and whenever he gets out on parole he will have to find employment and start paying again himself or else he'd be sent back. He will also owe the state for the payments made to me while he was incarcerated. I hope this helps. Good luck.

The state does not automanatally give a parent state benefits when the non-custodial parent is in prision, it is true that the custodial parent can apply for state benefits (welfare) and recieve benefits, and the state will prusue the non-custodial parent for any monies they may pay out for the child(ren).
