Question

Asked 6/7/2011

Have I any rights to fathers will that he stated he had provided for me all my life when he lived in Florida and I lived in Kentuucky?

I found out by a neighbor that my father had passed away. He lived in Florida and I lived in Ky. He left my mother and I when I was a very young little girl. I'm also his only biological child. I sent for a copy of his will where he stated that he had provided for me during his lifetime. He left everything to his step-sons. Don't I have any rights to anything of his? He never provided me with anything nor paid child support.

Hi, sjr7248, and welcome to WebAnswers.

Under Florida law, you are not entitled to anything of your father's, since he had a will in which he did not make a bequest to you. You can, however, challenge the will if you believe there is a valid ground or grounds by which to do so, but you will have to consult with a Florida attorney to find a valid issue, which might be expensive in the long run.

The overall value of the estate may inform your decision.

My only other thought is to ask if he actually divorced your mother. Because, if not, then the picture changes considerably.

If he did obtain a proper divorce and an order for child support was issued, your mother MIGHT be able to sue the estate for past due child support, although she will be challenged as to why she did not do so sooner, under the doctrine of laches.

I hope this is helpful to you. Thank you for choosing WebAnswers as your sourceā„¢.
