Does Mom have to pay child support if child moves to live with Dad permantly

Hi does a Mom have to pay child support if the child moves to live with the father permanetly or for a period of a couple years. What does Ohio Child support law say? Will the Dad automatically get full custody? Right now mom has full custody.

Child support is based off of where the child lives and comparitive incomes. If the child is living with the father and he's responsible for the expense of raising the child, then yes, she'll have to pay. Custody could still reside with the mother but that's not really practical if something happens to the child and he/she needs medical attention.

Thank you so very much for your quick reply. Can't tell you how awesome it is. I have looked around the net and could not find the answer to my questions.

Could I bother you with one more? If we want to trade full custody from Mom to Dad, can we do it outside of court anyway but still have it legal? Trying to avoid court dates due to our jobs. Can this be done through an attorney? Any idea on cost?

You can actually come up with the terms and custody arrangement on your own, which is definitely better if you have a goood relationship with your ex. Rather than go through an attorney though, you might try a mediator which courts usually appoint anyway. They can assist you in drafting up an agreement and cover things that you might not have thought about, like vacation times, splitting holidays, choosing schools, etc.

Once you have an agreement, one of you takes it to the county court house to file. A letter will be sent to both parites giving them time to respond if they do not agree. After that, you'll be good to go. Good luck and glad to help.

Just a last comment, the court sees it in the best interest of the child if the parents can agree to things so if you come up with a plan that works for you and most importantly, the child, they will go with what you come up with.

This is great news! :) My ex is willing to start immediately on this with a mediator as you mentioned. We do want what is best for our child. And can come to agreements easily. Do you know of any websites for Ohio Child Support that I can point my ex too to so he believes this can happen? He always asks me for proof before we dive into anything. He has trust issues...lol

I don't know a specific site however, if you go to a divorce mediator (they handle things post divorce as well) quite often you'll find information that will help. I just did a search on Ohio Divorce Mediators and found this site: http://www.ohiodivorceforms.com/PracticeAreas/Divo rce-Mediation.asp

He's based in Cleveland but a lot of the information pertains to Ohio in general. My ex and I divorced 8 years ago, though we both agreed to see our mediator once again last year to clear up some issues around school and other parenting issues we didn't envision back in the original session.
