First you need to file for child support. If he does not have a job the court will still order child support based on the least amount for the child or children,under low incom. The court does not just not order child support because someone does not work. He will be ordered to pay the amount and if he does not pay then the court can do several things,he could lose his drivers licence,go spend some time in jail,and when he does get a job he could get his wages garnished. The child support will keep adding up in errors so when he gets a job he will have to catch up on all payments. Also when he does get a job you can file a motion with the court to modifly the orignal order based on his earnings.

Bt5107: you should of got a child support order granted though the court when the court granted you custody. If you did not then you will need to go to the court house and file for child support, the mother is as responiable to pay child support as a father is. Once the court grants the child support then allow a few weeks for the court to get the papers to the child support agency and within a few weeks you should start recieving child support. If you and the mother agreed though the court that she does not have to pay child support then this if granted is good for two years and you cannot file for child support within the two year period, if this is not the case then you need to go file.

Yes you can file for child support even if the father is not working. You should go to your local social services department, or the child support office, depending on what county you live in. The arrears will start to accumulate as soon as you file. They will give you a time to come in with all of your paperwork, they will ask the father to come in and explain why he isnt working, and contributing to the needs of his child, then they will tell him to get a job, and report back. The sooner you file for support, the sooner you will start to get support from the father....good luck, but remember, child support is to help offset the cost of raising a child, and it is his responsibility as much as yours to contribute to the child.
