Child support laws in alabama

I pay child support for my son ordered by Alabama. He turns 18yrs old this month and has dropped out of school. Do I still have to pay child support till he turns 19?

You will have to comply with the court order unless it is stipulated that if your child has dropped out of school that it renders the child support order void. If it does then you may still have to go back to the court and have the order modified or rescinded. Make sure you have documentation that your child has dropped out of school and when this happened, just your say so is not going to be enough for the court.

Do not stop paying child support until you have a signed order from the court stating you are no longer obligated to make the payments.

I believe the age of majority in the state of Alabama is 19, not 18, so you would have to pay until 19. To be on the safe side, I'd check on your Child Support Order Agreement papers or with your attorney. In some cases, if the child is going to college, support payments can be ordered even longer, but since your child dropped out, this would not apply to you.

You can petition the court to declare your son emancipated since he is no longer in school and if the court agrees, then you would no longer be legally required to pay support. But you can't just decide not to pay the support because you son is no longer in school, without taking some legal action. It is up to the court to decide.

I believe that the child support order does not say anything about whether your son is still in school until the age of 19.

It should only state that if he continues into some type of secondary education you must continue paying the stipulated amount of child support until either he completes his secondary education or reaches the age of 23.

Even though he has left school, you are still required to continue the support payments until he reaches 19. (If your son is smart, he will go to the Court Clerk and ask for a form that will allow the payments to go to him instead of his mother until he turns 19. The form is free in most states, and family services will help him file it.)
