Child support law in puerto rico and florida

I am paying child support to my son. He is living in puerto rico and is living with his mother. I am living in florida and recently get married. We are working and living in florida. Does my new wife income could be affected. Florida law and puerto rico law are differents. In puerto rico, law take in count new wife's income, but florida not.

Your new wife can not be made to pay money directly to your ex wife for the child support.

But a wife's income can be taken into account in judging the overall picture of your financial security and your ability to make payments to support and benefit your child.

For example, it could be argued that your new wife's income is sufficient to pay the rent on your home, which otherwise you would have had to pay out of your income. This is because it's her home too.

If your ex wife has enough support with what you've been sending, then there's no problem. I'm sure you want to provide for your child.

But if she needs more money and you are able to send a little more now, this would be the best thing to do, rather than raise a big, stressful court battle over this issue.

The problem you may have to face is your new wife's wanting you to send as little as possible to your ex wife for the support of your child, especially when and if your new wife becomes pregnant with a child of her own.

Should that happen, this would be another factor, having the opposite effect of the first factor in your question. If you have one more new baby to support, again you are back to where you started, being able only to send a certain amount to your ex wife, because all the rest of your money has to be used for your new family.

This is why it's best to work it out with your ex wife, who, by the way, is going to be insanely jealous and angry that some other woman is now your wife, and will want to retaliate against you for getting remarried by asking you for more money.

Just try to weather the storm any way you can. It's a situation with no textbook answer. Time heals all wounds. Go to court only if necessary.
