Child support guidelines in Oklahoma If the custodial parent allows the child to live with the non costodial parent because of loss of employment, and the child support is only enough to cover rent, can the non costodial parent stop paying support as long as the child remains with him? |

The only legal way that custody and child support can change is by one or the other parent or both parents inagreement, file a motion to ask the court to modify the orignal custody and child support order. If the parent that has custdoy decides to let the father take the child then the child support order will still be in effect,by law there would have to be a change in custody before there can be a change in child support. If this happens that you both decide to do a non contested change of custody keep in mind that the parent that has the custody can also be ordered to pay child support to the other parent when the custody changes unless you both agree to having no child support enforced by the court.
