Can you help Me? My ex-husband has had a job making five hundred thousand dollars a year for the last 6 years. He never reported any change of income to me or the child support enforcement agency. He has only been paying me 300.00 a month since my daughter was 2 years old she is now 17. I was shocked that when I went to the child support enforcement agency that they could only collect from the date I called them. I feel horrible that he got away with this and I feel like I am to blame. Why is the burden always placed on the mother when he should have been the responsible party and submitted his income? |

If you are the custodial parent and you no that the non-custodial parent had a chance in income after the orignal order was in effect then you should of filed a petition with the court to modifly the orignal order, this is not your fault if you are not aware that your ex was earning more income and he did not report it. He is not oblagated to report a change in income, however usally the state will review child support every two years. However the state cannot keep track of every parents income and the changes this is why the custodial parent needs to file a petition to modifly the orignal order as soon as he/she finds that there is a report to change. Your child is 17 so I would still file to modifly the order for the next year.
