Can I get a copy of my paternity test results from the State? The State of California ordered me to take a paternity test to establish child support. I am not the boy's father. The State filed for child support and the case was granted; I was incarcerated at the time. I would like to obtain a copy of that test's results. I am not allowed to see the boy, pursuant to court order, but I am made to pay for his support. He's 14 now. Is the State of Calif. Child Support Services required to furnish me a copy of such results, and if not, is there anywhere else I can get the results from? Thank you for your consideration. I very much appreciate any assistance you can give me regarding this matter. Sincerely, J. A. Sheehan |

Yes when the state requires you to take a partenty test the results are sent to both parents,if you were not home at the time the papers were sent to you,you will need to call the child support services and tell them yo never recieved a copy of the DNA and you want a copy sent to you, they will not give you the results over the phone. If you find you are not the father then you would need to file a motion asking the court to stop the orignal child support order. The burden of proof is upon the state to prove your the father,so they have to give you the results.

You would have the right to challenge the results of the test, which would require you to see the test record itself.
Also, people are entitled to copies of their medical records in general, under federal law (the HIPPA law) and also under some state laws, including California.
If you feel a paternity determination was made in error possibly, you have the right to challenge the truth of the tests that were given. Only a physician could say for sure whether the test records would show some failure to indicate paternity, but you'd have no way to challenge the determination without examining the medical evidence.
Therefore, you should be able to get a copy of your medical records including the paternity test.
