Can I claim a tax deduction for dependent care paid even if I cannot claim my child?

My divorce decree states that my ex wife and I claim our son on alternating years. In 2010 I do not get to claim my son. Can I claim the child support I paid that goes to my sons Day Care expenses?

I have 73% of his day care expense and I would think I could claim that portion.

No, Unfortunately you can't claim the dependent care credit if the child does not live with you. Even on the years you get to claim him for his exemption and child tax credit, you still can't claim the daycare, only the custodial parent can.

You can't deduct child support at all, and it's not considered income to the parent receiving it.

The child would have to have resided with you and you would have to have supported that child in your home. IMHO is right when stating only the custodial parent can claim the daycare. As for deducting child support, perhaps it could be a decent idea to get more men and women to pay it. However of right now it is simply not possible to claim child support on your taxes, Although many wish it were possible.

Nope, married folks can't deduct every penny they spend on their kids, neither can divorced parents. It's just the way it is!
