California Child Support Rate Can California Child Support rate be an hourly rate instead of a monthly rate if the custodial parent never follows visitation and custody hours and days and has the child over 20% - 30% less than should? |

Visitation has nothing to do with child support. If there is a court ordered child support inforced though the court that order will remain in effect. If a prent does not follow a stipulated visitation order in regards to visiting thier child or children that is their decition the courts grant visitations they do not enforce the parent to see their child. Now if the parent that has custody is not complying with the court order allowing the other parent his or her visits then that parent can file a motion against the other parent for contempt of court. Also in order for child support to be dropped both parents would have to have the child 50/50 precent of the time and have joint custody.
