California child support payment increase I have been receiving the same amount of child support for several years for my son. I recently heard that the child support is suppose to automatically increase every couple of years to meet the needs of the child(ren). Is this true and if so, why haven't I seen the amended payments? |

It is not up to the child support division to increase your child support. The court determines the amount of child support to be paid. Child support just collects it. You can file a motion at ask the court to increase your child support payment if you feel you are not getting enought,that is how most child support is increased. unless your ex is making less than what he was at the time of the child support order you can probary get it increased,exspecially if its been a few years.

Thier are two instances you can request an increase in child support. First is, that it has been two years since child support was entered or last modified. Second is, that thier has been a change in income of either of at least 15% up or down (and the 2 year rule need not apply).
Child support does not increase automatically - you have to petition the Court for a modification. Its not hard, so if your wanting an increase, you should go ahead and petition the court.
