Back Child support My Boyfriend is going to court tomorrow for child support enforcement. He is back child support about 2000.00. he is now paying child support. can he go to jail if the enforcement was filed before he started making payements? |

This depends on the state you are in. Some states won't because he began to pay. Some states will because of the enforcement being sent already and they will require for the child support to be paid up to date. I have found that a lot of times, it depends on the other parent and what they say in court. If they request for him to be arrested, he can be. Other times, if they feel that the parent paying the child support is trying to work the system and the other parent to not go to jail, the judge will place an arrest to keep them from doing this.
It all depends on the state's laws and the judge who is presiding over the case.

If they are not taking out the full amount of his child support, I would suggest that since he knows they are not taking enough, that he go ahead and pay the remainder directly through the child support office. If he tells the court that the whole amount is not being taken from his checks, they will tell him that if he knows that this is taking place, that he should go ahead and send it and that it is essentially his responsibility.
However, if he is getting paid biweekly or weekly instead of bi monthly or monthly, then they are probably taking out the right amount as it has been calculated to that amount (with there being 4.5 weeks each month, then he will eventually have 3 incraments for biweekly or 5 incraments for weekly in one month that will take care of it.
I would also suggest that he gets a loan of some sort to pay off the child support and then pay the loan back to wherever or whomever he gets it from. This will at least guarantee that the court cannot arrest him on the back child support.
It is always a possibility that they will arrest him in court, but if he does not go in, a warrant will be placed and they will place a warrant for his arrest. It's a better option to go to court no matter what.
