Are there any new child support laws that will be passed after jan 1 2010 I heard a rumor that there will be a new child support law passed jan1 2010 in tennessee where they paying parent will no longer be incarcerated and that those who are locked up will be released is that true |

Well I reassure you that anyone that is incarcerated for child support will not get out until they have served their time,jail or prison. Also as of now there is no new laws going into effect for child support and jail time. The last time there was a new revised statues on child support was August/2008 and can be found in the rules of Tenneesse Department of Human Services Child Support Division-Chapter 1240-24, in some states a non-custodial prent can be sentenced to jail time up to six months, while incarcerated, if the parent are still responiable for the amount due and future payments. If the court finds that a non-custodial parent fails to obey the state laws their licence, could be suspened for 30 days, if prosecuted and sent to prison it will show up on their crimmal record as a federal offence. Delinguent child support payments also show up on credit reports. In Tennessee the law for enforcing child support are the most effective ways to ensure that the custodial parent receives payments. If a non-custodial parent avoids his obligations, then the custodial parent can request to have the child support enforced. Tennessee child support enforces payments by intercepting the IRS tax refund checks, reporting to the credit bureau, intercepting unemployedment benefits, and the denial of passport rights. Suspention of drivers licence and liens on property can also be used as an enforcement tool, wage garnishment.These are the laws in Tennessee hope it helps.

No it's not. My boyfriend is currently serving time in the Tennessee jail for child support, he filed a motion in cour to be released early and was not released. The DA Julie Ottman is FOS! He had money, job verifications, etc and she still declined it. I think that she has a personal thing for him to be honest. Who do you know will decline 3000.000?

I am sure this new law if were approved is every oncustodial parents dream if they do not want to pay child support, but the news is incorrect, there is no law going in effect for taking away the right to have a noncustodial parent prosucuted for back child support and everyone that is in jail for child support can relax their going to spend their ime.

Was there a new law passed by former president bush on arrears? i have been on child support since 2005. i was in prison from 2006 to 2010, meanwhile; my arrears racked up to over six grand. can i get that wiped out being that i was unable to pay during that time due to being in jail?
